By browsing the Site or submitting forms, you agree to the then-current Terms and our Privacy Policy. If you disagree, discontinue use.

The Site is operated by HRDNOX Labs as a trade style of Terry Brazil (“we”, “us”, “our”). Certain pages reference Rocky Road Designs, a branded lane focused on websites. Rocky Road Designs is not a separate legal entity unless expressly stated in a signed engagement with you.

You agree not to:

• Violate applicable law, sanctions, export controls, or third-party rights.
• Probe, disrupt, or attempt unauthorized access to our systems, accounts, or hosting providers.
• Deliver malware, phishing, crypto drainers, or abusive payloads through forms or linked content.
• Harass, threaten, impersonate, or spam us or other visitors through Site channels.
• Misrepresent identity, authority, or affiliation when requesting services or partnerships.

Descriptions, screenshots, pricing ballparks, timelines, app store badges, and portfolio links may change without notice. We aim for accuracy but do not warrant that every statement is error-free or current at the moment you read it.

Forms route information you supply to our email workflow. Submitting a message does not create a contract, statement of work, confidentiality agreement, SLA, timeline guarantee, obligation to reply, quote acceptance, joint venture, or employment relationship unless separately documented and signed where needed.

Rocky Road Designs pages may illustrate example pricing tiers. Figures are illustrative — final scope, deliverables, revision rounds, payment schedules, integrations, refunds, uptime, indemnities, warranties, termination, licensing, and intellectual-property assignment belong in explicit written proposals or contracts executed after intake.

Mobile apps are distributed through storefronts operated by Apple, Google, or similar vendors. Those transactions are subject to separate end-user licenses, refunds, parental controls, and privacy disclosures. Store policies—not these Terms—govern downloads, subscriptions, restores, receipts, geographic availability, ratings, moderation, disputes, refunds, and platform fees.

The Site links to portfolios, collaborators, podcasts, Discord or community hubs, Shopify, Stripe, merchants, calendars, and other third parties whose terms and privacy notices apply independently.

Logos, design systems, typography pairings, copy, screenshots, thumbnails, aggregated layout, gradients, ambient motion patterns, and original code comprising the Site are owned by HRDNOX Labs or licensed for use. You receive a limited, revocable, non-exclusive license to view the Site for personal or internal business evaluation — not to copy, redistribute, or create derivative works except as allowed by law.

Trademarks of partners, clients, app stores, or open-source projects remain their respective owners; references here do not imply endorsement beyond factual description.

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED—INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow warranty exclusions; those exclusions apply to you only to the maximum extent permitted.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HRDNOX LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR FOR LOSS OF PROFITS, REVENUES, GOODWILL, DATA, OR SECURITY BREACH LOSSES — EVEN IF ADVISED OF POSSIBILITY — ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SITE.

OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE AMOUNTS YOU PAID US DIRECTLY THROUGH THE SITE DURING THE SIX MONTHS BEFORE THE CLAIM. THE SITE MOSTLY DISTRIBUTES INFORMATION; IF YOU DID NOT PAY US ONLINE, (A) USUALLY CONTROLS.

You agree to defend, indemnify, and hold harmless HRDNOX Labs from claims, liabilities, losses, settlements, judgments, costs, and fees—including reasonable attorneys' fees—to the extent arising from your misuse of the Site, your violation of law, unlawful content submitted through forms, or misrepresentations attributable to your submissions (except to the extent finally adjudicated wrongful as to us alone).

These Terms are governed by the laws of the State of Michigan, United States—without regard to conflicts-of-laws principles—exclusive of its choice-of-law conflicts. Venue for permissible court actions rests in Chippewa County or federally in the Upper Peninsula federal division where applicable, unless we mutually agree differently in writing for a discrete commercial dispute.

If any provision is unenforceable, the remainder survives. You may not assign these Terms absent our written consent. We may assign in connection with a merger, financing, reorganized studio, successor website, infrastructure migration, acquisition, asset sale involving the Site—or to affiliates assisting operations.

We may revise these Terms periodically. The “Last updated” date atop this page reflects the latest substantive revision, excluding minor typography-only edits unless stated. Continued use after posting changes constitutes acceptance; if you oppose a change, discontinue use—especially discontinue sensitive form submissions.
